Penalty for violating the work order in the Kuwaiti Labor Law


(Article 47)


The employer must keep a permanent record of his workers that includes as a minimum - the name of the worker, his profession, nationality, place of residence, marital status, date of commencement of his service, his wages, penalties imposed on him, annual and sick leaves he obtained, date of termination of his service and the reasons thereof.


(Article 48)


The employer must organize a permanent work card for each worker, to hand him a copy of it and keep the other.


(Article 49)


The employer shall post in a conspicuous place at the workplace a working list provided that it includes in particular the daily working hours, the weekend and official holidays.


(Article 50)


An employer who employs ten workers or more must post, in a visible place at the workplace, a list of penalties that may be imposed on his violating workers, in accordance with the rules contained in Article 51 and what the Ministry of Social Affairs decides to do.


(Article 51)


In preparing and implementing the penalties regulations, the following rules shall be observed:

1 - That the regulations specify the violations committed by the workers and their degrees.

2 - To include a progressive list of sanctions.

3 - That no more than one penalty be inflicted for a single violation.

4 - That the worker is not subject to the penalty for an order he committed outside the workplace, unless it is related to the work.

5 - That the deduction does not exceed five days' wages per month.

6- The suspension should not exceed ten days per month.

7 - That the worker is not punished for something he committed, and fifteen days have passed since the 

date on which it was proven, or the date of payment of wages usually.
