Injustice and prejudice to the legal rights of Kuwaiti women
International news agencies published news from Saudi Arabia that underage marriage was prohibited, and the age of marriage was set at 18 years, and the Personal Status Law was changed so that the first wife has the right to request a divorce if her husband marries a second wife. We congratulate Saudi women for obtaining these rights, and we hope for them to achieve more at the end of the coming years. I teach at Kuwait University a special course on women in the Arab world, and within the course students are required to study the legal guide for women by Dr. Badriya Al-Awadi .. especially the section on personal status law.
Whoever reviews the Kuwaiti Personal Status Law, which was issued on July 7, 1984, is surprised by the injustice and unfairness of Kuwaiti women ... and how such an unjust law has been passed by the representatives of the nation and the government .. Here are some examples:
Do women have the right to marry themselves off?
A woman has the right to marry herself if she is a widow or has reached the age of twenty-five, and the law requires the consent of the guardian, meaning that she is not entitled to initiate marriage procedures without a guardian on her behalf. The question: Why insist on the consent of the guardian if the woman is over the age of 25 years Why shouldn't she be a trustee?
The question is what is competence in marriage?
The answer is that the condition of competence is reform in religion .. in the sense of knowledge, culture, good reputation, work and financial ability that have no place in the face of reform in religion. The question: Who decides on reform in religion?
Dr. Al-Awadi emphasized that the Personal Status Law contradicts in some of its provisions the Convention on the Elimination of All Forms of Discrimination Against Women, especially the articles dealing with the provisions of guardianship, guardianship, guardianship, marriage, divorce and inheritance in Kuwaiti society, where women are prohibited from marrying themselves and in the event of divorce is limited to the husband or whoever In his place, while the woman is not entitled to divorce herself, except with the approval of the judge.
Kuwaiti Penal Code No. 16/1960 permitted a man to beat his wife as a right to discipline .. The law did not establish any penalty against the man in case he abused this right.
What about cases of adultery Article (153)?
If a man surprises his wife in the event of adultery, his daughter, his mother, or his sister and kills her immediately, or kills those who commit adultery with her, or kills them together, then he is punished with imprisonment for a period not exceeding three years and a fine not exceeding three thousand rupees or one of the two penalties. (Three thousand rupees is now around 18 dinars).
The question is, what happens if the wife surprises her husband in fornication, even if in the marital bed, and proceeds to kill him? What is her punishment? The punishment for it is death or life imprisonment, not imprisonment and a fine, as in the case of a husband.
Women of Kuwait, unite, organize yourself and protect you in laxity and indifference to your legitimate, international and human rights ... The world today has no mercy for the weak.
